General Conditions

2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via an appropriate method. What is a 'material change' is at our discretion.
3. We reserve the right to refuse service to anyone for any reason at any time.
4. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.

Stores

 

We at aYwaa.com online store facility are thankful to the members willing to become owner of online stores in relation with aYwaa.com social group & creating sales market. In accordance to same, this must be taken as a notice by all members doing business via online stores of aYwaa.com that it is the property of aYwaa.com & misuse of which is strictly prohibited by participants. The facilitator aYwaa.com reserves the right to terminate your participation membership as Merchant in stores section at any point of time without notice if it comes across a situation that one or more of the following has occurred:

 

1. A member is in breach of this Agreement or any of the Additional Terms.
2. Average number of complaints passes against a member relating to the quality of service as a Merchant or Retailer.
3. There has been a complaint against merchant member relating to material defects in the quality of his services, whether or not founded.
4. There have been an above average number of complaints against member for being non- responsive to communications from other participants in aYwaa.com
5. For incorrect account information of a member or
6. For engagement in an activity that may potentially damage the reputation of aYwaa.com or that of any other participant or an activity that may potentially damage the goodwill associated with the aywaa.com.

 

In order to be the owner of an online aYwaa.com Stores, members are required to follow our standard policies like

 

• Fill up & post registration form. The registration process requires members to provide certain information to aYwaa.com, which may include personal information. Please see our Privacy Policy posted on the aYwaa.com website.
• As a member you must agree to provide true, accurate, current and complete information about yourself and to promptly update this information as required to keep it true, accurate, current and complete.
• A member will have no right to participate in aYwaa.com as a Merchant or Retailer, unless and until aYwaa.com has notified you that your registration has been accepted.
• aYwaa.com may reject your application based on our determination that your Business is unsuitable for aYwaa.com website. Unsuitable Businesses include, but are not limited to, those that do not meet the requirements of this Agreement or the Additional Terms.

 

We hereby also make it clear that after being a member of aYwaa.com Store,

 

• You will be solely responsible for the operation and maintenance of your Business.
• You are solely responsible for all material that appears on your store or in other marketing and promotional materials used in your Business, other than those portions which are part of aYwaa.com website.
• aYwaa.com is not responsible in any way whatsoever for any representations, warranties, descriptions or statements used in your marketing and promotional materials howsoever distributed by your Business.
• In order to keep up your registration in good standing with aYwaa.com, you are responsible for ensuring that your store, promotional and marketing materials, as applicable, and any related products or services meet the requirements of this Agreement and aYwaa.com Rules.
• You shall not conduct yourself in any manner, including without limitation, sending of unsolicited mail or spamming any Internet bulletin board, which may have the effect of damaging the goodwill associated with aYwaa.com website or creating any negative views of aYwaa.com.

 

In addition to the restrictions set out in aYwaa.com Rules, you shall not publish, link to, provide, offer to provide, sell, offer to sell or otherwise deal in any information, material, content, Product or Service which:

 

1. is obscene or contains pornography of any kind
2. infringes any third party intellectual property or proprietary rights including without limitation, copyright, patent, trademark, trade secret, right of publicity or privacy
3. is stolen property including pirated software or music
4. is unlawful, threatening, abusive, harassing, tortuous, vulgar, hateful or is racially or ethnically offensive
5. is defamatory or libelous of any person or organization or
6. is harmful including, without limitation, to any person's health or safety at risk, places the integrity or security of any computer system at risk or distributes any virus, Trojan horse, worm, time bomb or other harmful or invasive computer program

 

Further, along with the restrictions set out in aYwaa.com Rules, you as a member shall not, in relation to aYwaa.com:

 

1. use keyword, search term or other identifier without the consent of the third party that includes or incorporates a trademark of the third party for use in association with your store, with any search engine, portal, advertising service or other search or referral service or otherwise
2. use name of aYwaa.com to commit any dishonest act, act of fraud or any act which infringes any right of a third party
3. undertake any activity which creates liability, loss or damage or potentially creates liability, loss or damage to shopper or any other participant in the Online Shopping Marketplace.
4. conduct yourself in any manner which does or which is intended to deceive anyone in relation to anything, including, in relation to ownership, authority or source
5. make available or send any unsolicited or unauthorized advertising, promotional material, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation or

 

You agree to comply with all countries and their governmental laws, rules, regulations and orders that apply to your activities, including but not limited to, tax, export and import, embargo and trade sanctions, intellectual property, consumer protection, unfair competition, discrimination, false advertising, content, sales, mail-order, commerce and e-commerce laws and regulations. You are responsible for determining which laws and regulations apply to you and that your participation in aYwaa.com complies with those laws and regulations.

 

We claim no intellectual property rights over any material you provide/upload or contribute to the aYwaa.com service.
